We at Hummingbird Lawyers LLP recognize how important it is to you to maintain your right to privacy and to keep personally identifiable information private from others. In order to ensure these rights are protected and your information is secure, we maintain a strict privacy policy. Please take a look at this policy in order to understand how we manage and/or maintain your private and personal information.

Hummingbird Lawyers will always maintain and honour our professional obligation to keep confidential all information received within the scope of the lawyer-client relationship.

  1. Collection of Personal Information

Hummingbird Lawyers may collect personal information, either verbally or by written correspondence. These manners include (but are not limited to), personal meetings,        e-mail, regular mail, facsimile, telephone calls, or voice mail. However, personal information may be obtained in other ways. For example,

  • insurance companies;

  • investigators;

  • real estate agents in a property transaction;

  • witnesses in litigation matters;

  • other parties to a transaction or file you have retained us to work on;

  • government agencies or registries; and

  • accountants and other consultants.

As a result, you as a client imply your consent of Hummingbird Lawyers obtaining information in this manner, provided it is for the benefit of, or useful to, the purpose of your retainer or needs.

  1. Use and Disclosure of Personal Information

Hummingbird Lawyers professionals employs a variety of staff, including law clerks, paralegals, articling students, associates, and student-interns, as well as the firm’s management staff. These staff may be privy to and use your personal information solely for the purposes of client work, such as providing legal and related services to individuals and corporations, for precedents usage, to administer client accounts, including time, billing and contact information databases, to perform conflict searches, to enhance our relationship with clients. Such information may also be used to provide updates to you. In addition, we may send you holiday or greetings cards on behalf of the firm or our practioners. If you are already a client at Hummingbird Lawyers, please be aware that we maintain your client information to facilitate the provision of ongoing or future services.

Subject to our professional obligations to keep client information confidential, under certain circumstances the firm will disclose Personal Information to a third party without express client consent, including where required, or authorized, by law (e.g. if a court issues a subpoena) or where the legal services you have retained us to provide requires us to give Personal Information to a third party (e.g. to a lender in a real estate mortgage transaction, to a government agency for permit applications, consents etc., and any other organization or enterprise when required for services to and for clients).  It is important to note that if you relinquish information of another individual to Hummingbird Lawyers, you are representing that you have the necessary consent or authority to allow us to collect, use and disclose such information for any of the purposes set out within this Privacy Policy.

Hummingbird Lawyers may, from time to time, be required to disclose certain client information to third parties for the purpose of processing (e.g. computer back-up or other administrative needs) or any other third party services related to services rendered to and for clients. If ever such disclosure of your information is required, we will ensure that the use of this information is strictly for the specified purpose and we agree to provide a level of protection to the information that is at least comparable to our own.

  1. Safeguarding Your Information

We at Hummingbird Lawyers will always take all necessary and reasonable steps to ensure that your stored personal information is kept safe from loss or theft, or unauthorized copying, use, access, modification and/or disclosure.

While we take all reasonable steps to safeguard Personal Information under our control, there is always an inherent risk involved in the information exchange when using any form of communication, such as email, telephone, fax and courier service. Hummingbird Lawyers assumes no liability for any damages you may suffer as a result of interception, modifcation, or misuse of information during such transfers. Email is often our preferred method of communication and we may use unencrypted plain text emails when communicating with you unless you object otherwise.
