Elder Law is the legal practice area focused on the aging population. It encompasses a wide area of law including estate planning, mental capacity, long-term care, elder abuse, fraud, predatory marriages, isolation, and many other aspects vulnerable people face. The term “Elder Abuse” can be physical, emotional or financial. It comes in many forms and is increasing at alarming rates. According to research gathered through the Department of Justice Canada (2023) “About 45 percent of seniors report experiencing some form of abuse from the age of 65 on.”
Hummingbird Lawyers is a huge advocate for protecting vulnerable clients and has been involved with fighting for change both Nationally and Provincially. We are pleased to provide consultations to older adults or their families, in Elder Law.
The World Health Organization defines elder abuse as a single or repeated act occurring within any relationship of trust that causes harm or distress to an older person. Globally 1 in 6 people aged 60 or older experience some form of abuse every year. Elder abuse includes physical, psychological, emotional, financial, and sexual abuse as well as neglect and abandonment.
Financial fraud and scams targeting older Canadians are increasingly common. If you or someone you know has been targeted by a scam or financial exploitation there are resources available to report it and get help. Knowing how and where to report is the first step in protecting yourself and others.
People living with dementia and Alzheimer’s disease are particularly vulnerable to elder abuse. The Alzheimer Society provides resources and guidance on recognizing the signs of abuse in those with cognitive impairment and how families and caregivers can take steps to prevent it.
Canada’s national seniors advocacy organizations work to protect the rights, dignity, and wellbeing of older Canadians. These organizations provide information, support, and advocacy resources for seniors and their families navigating complex legal, health, and social issues.
If you have concerns about the care being provided in an Ontario long-term care home there is a formal complaint process available. The province provides a mechanism for residents, families, and the public to report issues and have them investigated by the appropriate authorities.
Ontario maintains a public database where you can search the complaint and inspection history of licensed retirement homes. This is a valuable tool for families researching care options or concerned about the standards at an existing facility.
